TERMS & CONDITIONS
These terms and conditions (“User Terms”) apply to Your visit to and use, of the Site whether
through a computer or a mobile phone, the Service and the Application, as well as to all
information, recommendations and or services provided to You on or through the Site, the Service
and the Application. This document is an electronic record in terms of Information Technology
Act, 2000 and rules thereunder as applicable and the provisions pertaining to electronic records
in various statutes as amended by the Information Technology Act, 2000. This electronic record
is generated by a computer system and does not require any physical or digital signatures.
By clicking on the “I ACCEPT” button or by using Y Junctions’s services, You are
consenting to be bound by these User Terms. PLEASE ENSURE THAT YOU READ AND UNDERSTAND ALL THESE
USER TERMS BEFORE YOU USE THE APPLICATION. If you do not accept any of the User Terms, then
please do not use the Application or register or avail any of the services being provided
therein.
YOUR AGREEMENT TO THESE USER TERMS SHALL OPERATE AS A BINDING AGREEMENT BETWEEN YOU AND Y
JUNCTION IN RESPECT OF THE USE AND SERVICES OF THE SITE.
Your acceptance of the User Terms shall be deemed to include your acceptance of the privacy
policy available at (please mention the weblink of privacy policy). By accepting these User
Terms, You also allow Y JUNCTION to send you promotional emails and SMS alerts from
time to time.
IT IS HEREBY EXPRESSLY CLARIFIED THAT Y JUNCTION AND THE USER SHALL ALSO BE GOVERNED BY THESE
USER TERMS.
1. DEFINITIONS
All of the defined terms in these User Terms will have the meaning assigned to them here below:
- “Customer Account” shall mean the account created by the Customer on the Application for
availing the Services provided by Y JUNCTION.
- “Leader Account” shall mean the account created by Leader on the Application of Y JUNCTION.
- “Labour/Partner Account” shall mean the account/registration created/obtained by the
Labour/Partner on the Application for availing the Services provided by Y JUNCTION.
- “Application” shall mean the mobile application “Y JUNCTION” updated by Y JUNCTION from time
to time.
- “Commission” shall mean the fee payable by the Customer to Y JUNCTION for the Service i.e.,
for availing the technology services offered by Y JUNCTION. Commission shall be charged on
every booking made through the Site/Application. The Commission shall include the commission
payable by labour/partner to the “Y JUNCTION”, which the Customer will be able to deduct
from the labour wages.
- “Customer/ You” means a person who has an Account on the Application.
- “Leader” means an individual who shall be assigned a position of Leader, for a group of
certain number of workers, by the Y JUNCTION and registered as Leader on the application of
Y JUNCTION.
- “Labour” shall mean and include such individuals doing construction works and who got
registered as Labour under the Y Junction’s Application.
- “Partner” shall mean and include such individuals doing electrical, carpentry, sanitary
fittings, and other home services as provided under the Application and who got registered
as Partner under the Y Junction’s Application.
- “Force Majeure Event” shall mean any event arising due to any cause beyond the reasonable
control of Y JUNCTION.
- “Y JUNCTION” or “us” or “we” or “our” shall mean Y JUNCTION PRIVATE LIMITED, a company
incorporated under the provisions of the Companies Act, 2013 and having its registered
office at H. No 1-8-46/1, Ground Floor, Ganesh Puri Colony, Dilsukhnagar, Hyderabad,
Telangana - 500060, which expression shall, unless it be repugnant to the context or meaning
thereof, be deemed to mean and include all its successors, affiliates and permitted assigns.
- “Registration Data” shall mean and may include the present, valid, true and accurate name,
email ID, phone number and such other information as may be required by Y JUNCTION from the
Customer from time to time for registration on the Application.
- “Service(s)” means the facilitation of the services by Y Junction through the Application.
2. ELIGIBILITY
The Customer/Leader/Labour/Partner must have attained at least 18(Eighteen) years of age and
shall be competent to enter into contract under the Applicable Laws. If You reside in a
jurisdiction that restricts the use of the Service because of age, or restricts the ability to
enter into contracts such as this User Terms due to age, You must abide by such age limits.
3. REGISTRATION AND ACCOUNT
- You shall ensure that the Registration Data provided by You is accurate, complete, current,
valid and true and is updated from time to time. We shall bear no liability for false,
incomplete, old or incorrect Registration Data provided by You.
- You are solely responsible for maintaining the confidentiality of Your Registration Data and
will be liable for all activities and transactions that occur through Your Account, whether
initiated by You or any third party. Your Account cannot be transferred, assigned or sold to
a third party. We shall not be liable for any loss that You may incur as a result of someone
else using Your password or Account, either with or without Your knowledge.
4. SERVICES
The Application allows you to avail multiple services offered by Y JUNCTION.
TERMS AND CONDITIONS FOR CUSTOMER
- The Labour/Partner by accepting the request for construction/domestic services placed by the
customer on the application hereby agree to work for the wages as displayed on the
application after the deduction of commission remitted by Customer to THE Y JUNCTION on
behalf of such labour/customer.
- The Labour/Partner or Leader accepting the request on behalf of Labour/Partner after
accepting the request shall be responsible for arriving at the location mentioned by
customer at the specified time without any delay.
- No Labour/Partner shall smoke/consume alchohol at the work place/ or arrive at the work
place in a drunken state.
- The Labour/Partner will not be provided any transportation charges.
- The Labour/Partner shall not indulge in any unnecessary communications and shall not
misbehave with the Customer/Co-Labours/Partners.
- The registration of the Labour/Partner shall be cancelled upon receipt of 3 complaints of
delay in arrival/improper behavior at the workplace upon the discretion of the appropriate
authorities of the Y JUNCTION.
- The Y JUNCTION shall not be responsible for payment of wages and the safety of workers at
the workplace; however the Labour/Partner may register the Complaint with respect to
non-payment of wages or any other matter with the appropriate authorities of the Y JUNCTION.
- The Y JUNCTION shall not be responsible for any disputes arising between the
Labour/Partner/Leader and Customer
- Equipment required for the work shall be brought by Labour/Partner/Customer based on the
nature of work and equipments required based on general practices and Y JUNCTION shall not
be responsible for providing any kind of equipment.
SPECIFIC TERMS AND CONDITIONS GOVERNING THE POWERS AND RESPONSIBILITIES OF LEADER
- An individual shall be assigned a position of Leader by the authorities of Y JUNCTION for a
group of labours and such Leader shall be entitled to a Commission of such percentage as may
be decided by the Authorities of Y JUNCTION.
- The Leader shall update to Y JUNCTION by 8.P.M everyday with respect to availability of
labour for the next working day.
- When an order/request is placed on the Y JUNCTION Application, the Leader will receive a
notification on the application and the leader may accept it subject to the availability of
labours in his work.
- Once the Leader accepts the request, the details of the workplace and contact details of the
Customer will be shared to him and he shall be responsible for Coordination and
communication with the Customer.
- The Leader shall ensure that the required number of labour as per the request of the
Customer reach the workplace mentioned by such Customer.
- The Leader shall not harass/misbehave with any of the Labours.
- If any of the Labour misbehaves/indulge into unnecessary fights with the Leader, the Leader
may complaint against such labour with the Y JUNCTION.
- The Leader shall report to the Y JUNCTION the instances of misbehavior/delay in work
performance by any of the labour in his group at the workplace.
4. PAYMENTS
- The wages for the Labour/Partner Services may rise due to the huge demand in the market/non
availability of labour or any other factors, however the Customer will be able to view the
price and the customer placing a request will be deemed to have the knowledge of the
Increased wages.
- The Customers may be provided with discounts/coupons on the wages/commission charged by the
Y JUNCTION from time to time at the sole discretion of Y JUNCTION.
- The charges for the Services of Y JUNCTION shall be updated or amended from time to time at
the sole discretion of the Company and it shall be your responsibility to remain informed
about the charges for the Services.
- The Customer agree and undertake to share relevant payment details including credit/debit
card details (Card Details) with the Payment Gateway(PG) for the successful completion of
payment towards Total Commission to the Y JUNCTION and authorize the PG to complete such
transactions. In this respect, it is clarified that all PGs whose services are utilized for
the purposes of the Site and/or Application and/or Services shall be PCI-DSS (Payment Card
Industry – Data Security Standard) compliant.
- Any payment related issue, except when such issue is due to an error or fault in the Site,
shall be resolved between You and the Payment Processor. The Y JUNCTION shall not be
responsible for any unauthorized use of Your E-Wallet during or after availing the Services
on the Site.
5. FORCE MAJEURE
- Y JUNCTION shall not be liable for any failure to perform any obligations under this User
Terms, if the performance is prevented, hindered or delayed by a Force Majeure Event and in
such
case our obligations under this User Terms shall be suspended for so long as the Force
Majeure
Event continues.
6. MODIFICATION OF THE SERVICE AND USER TERMS
- Y JUNCTION reserves the right, at its sole discretion, to modify or replace, in part or
full,
any of these User Terms, or change, suspend, block, discontinue or restrict your use to all
or
any feature of the Service or Application at any time.
- Y JUNCTION shall notify you of any changes made to these User Terms by way of
Emails/Notifications on your Applications. The revised User Terms shall be made available on
the
Site. Y JUNCTION may require You to provide Your consent to the updated User Terms in a
specified manner prior to any further use of the Site and the Services.
7. DISCLAIMER
- You agree that Y JUNCTION is merely an electronic platform to facilitate connect the
Customer
and the Labour/Partner, Y JUNCTION makes no representation, gives no warranty, or guarantee
regarding the reliability, timeliness, quality, suitability or availability of
Labour/Partner or
their services provided through Y JUNCTION.
- We do not authorize anyone to make a warranty on Our behalf and You shall not rely on any
statement of warranty as a warranty by Us.

9. APPLICABLE LAW AND DISPUTE RESOLUTION
These User Terms are subject to the laws of India. Any dispute, claim or controversy arising out
of or relating to these User Terms or the breach, termination, enforcement, interpretation or
validity thereof or the use of the Site, the Service or the Application (collectively,
“Disputes”) the parties shall attempt to settle the same amicably, through negotiation and
consultation at such offices of Y JUNCTION as Y JUNCTION may designate. In the event the dispute
is not resolved internally between after at least 30 (thirty) days of negotiation, in good
faith, then any Dispute will be subject to the exclusive jurisdiction of courts in Hyderabad,
India.
